IMPORTANT

These terms and conditions set out your rights to use our Facilities and Services and the responsibilities you have to comply with as a Member. These responsibilities, including payment of Membership Fees, do not depend on how often you use our Facilities and Services.

You should read through the terms and conditions fully to make sure they reflect your expectations.

If you are unsure whether any particular statements that you have relied on are part of these terms and conditions, or if you have any queries regarding a membership, please ask us.

Direct Debit Information: If an automatic direct debit arrangement is in place, your Membership Fees will continue to be debited from your account weekly until you or we cancel the arrangement by advising with 30 days written notice. If you end a membership or stop the automatic debit arrangement in a way not described, you may be liable for damages for breach of contract.

KEY TERMS

COOLING OFF: You can cancel a Membership within 7 days from the start date by giving us written notice (see clause 4).

SAFETY: You agree to give us all relevant health and fitness information before or during any exercise. Each time you use the Facilities and Services, you must ensure you are in good physical condition and know of no medical or other reason why you should not exercise. If unsure, you should seek medical guidance (see clause 6).

ACCESS: When you join Edge, you have access to services within the confines of your membership and/or arrangement (e.g. group classes, open gym and/or personal training). You will have access to Edge during your booked appointments within standard operating hours (see clause 3).

PUTTING MEMBERSHIP ON HOLD: You may put your Membership on hold for a minimum period of two (2) weeks and a maximum period of three months each year while on an ongoing membership. Each year commences on the anniversary of your Commencement Date. To place your account on hold, please email your request. It is your responsibility to be aware of when debits will resume after being on hold (see clause 8).

CANCELLING YOUR MEMBERSHIP: You may cancel an ongoing membership with 30 days written notice (see clause 9).

INDEMNIFICATION: These terms and conditions serve as a liability release, pursuant to which You agree to indemnify and hold Edge Functional Training harmless against any and all claims of loss or damage without limitation.

GYM RULES & PARTICIPATION: You hereby agree to abide by all posted and/or directed safety guidelines and regulations while using Edge Functional Training facilities and equipment. Additionally, you agree to conduct yourself in a manner deemed appropriate for a fitness facility.

Edge Functional Training reserves the right to restrict your access if these terms are violated.

1.0 DEFINITIONS

Edge”, “We” or “Our” means Edge Functional Training.


Commencement Date” means the date that your Membership commences.


Facilities” means the gym equipment, machinery, amenities and other facilities available at, or through Edge. “Fee/s” means the fees payable by you to join and participate in the Membership.


Member” or “You” means the person joining the Membership.

 

“Membership” means your membership with Edge Functional Training, being the type specified when you join.


Ongoing Membership” means a membership that continues on an ongoing basis with ongoing payments.


Services” means classes, open gym, personal training, programs and other health and fitness services provided by Edge.

"Terms and Conditions" means these terms and conditions as described in the Important Notice.

2.0 OPTING FOR ONGOING MEMBERSHIP

2.1 Subject to clause 4, you acknowledge and agree that by proceeding with an ongoing, direct debit Membership, you have entered into an agreement with us. You further acknowledge that this agreement is the entire agreement between us and you and no other representation is to be relied upon.

2.2. As such, you should seek independent advice and/or let us know if you have any queries relating to this agreement prior to proceeding and by proceeding, you acknowledge that you have been given the opportunity to obtain such independent advice.

3.0 JOINING AND ACCESS

3.1 When you join Edge, you will need to give us personal information and possibly, photographic identification. If you join under a particular offer, such as a corporate offer, you will also need to give us proof that you are eligible for that offer.

3.2 When you join Edge, you will have access to Services within the confines of your Membership and/or arrangement (e.g. group classes, open gym and/or personal training). You will have access to Edge during your booked appointments within our standard operating hours: 6am - 7pm Monday to Thursday, 6am - 5pm Friday.

4.0 COOLING OFF

4.1 If you change your mind after joining, you have 7 days to cool off or cancel your Membership starting on the Start Date. To be effective, you must let us know in writing at any time during this 7 day cooling off period. Your written cancellation can be given by email and sent to: train@edgefunctionaltraining.com.au

4.2 If you cancel your Membership under clause 3.1, we will charge you for any services or products already provided.

5.0 SERVICES

5.1 In conjunction with payment of Fees, we agree to provide you with access to the Facilities and the Services during your booked appointments, during your membership.

5.2 Some Services, such as personal training, are a separate Membership and may require payment of additional fees as offered by the relevant trainer. Full particulars will be provided upon request.

5.3 You acknowledge and agree that the Fees are reviewed periodically and may increase. This is regardless of the Fees payable when you entered into a Membership or the Term (unless you have pre-paid in advance). You will be notified with a minimum of 30 days prior to any such Fee increase.

6.0 HEALTH & SAFETY & ACCEPTABLE CONDUCT

6.1 Your physical condition

a) When you proceed with a membership and each time you use the Facilities and Services, you must ensure you are in good physical condition and know of no medical or other reason why you should not exercise. If unsure, you should not use the Facilities and Services until you have sought appropriate medical guidance and been given the go-ahead.

b) You agree to give us all relevant personal health and fitness information both before and during the course of any exercise program or other activity. You also agree to complete a Pre-Exercise Questionnaire. In some cases, responses you give will require that you get medical guidance before exercising. You acknowledge that pre-exercise or other screening is no substitute for medical advice and does not guarantee against injury or death.

c) You promise that information you give us will be true and accurate and not misleading in any way.

d) You must not use the Facilities and Services if you are suffering from any illness, disease, injury or other condition that could be a risk to your health or safety or that of other Members and others.

6.2 Proper use of equipment

You promise to take care to use the Facilities and Services safely and properly. If you are ever not sure how to operate any equipment properly, you agree to ask Edge staff first.

6.3 Your Obligations


a) You agree to, at all times, abide by the rules of conduct, behaviour, dress code and other policies or rules in place.

b) If you behave in a risky or seriously inappropriate way, for example, if you threaten or harass others, damage equipment, distribute or use illicit substances, or train other Members without our authorisation, appropriate action will be taken. For example, your Membership may be immediately suspended or cancelled (with a Cancellation Fee potentially applying), you may be banned from re-joining and/or we may refer the matter to appropriate authorities. If your conduct causes us or another person costs, loss or damages, you agree to pay for these.

c) If you break any of the Edge rules we will respond in a way we consider fair and appropriate. For example, in less serious cases, we may give you a warning but in serious cases or where you have repeatedly broken Edge Rules we may suspend or cancel your Membership. If your breach causes us or another person costs, loss or damages, you agree to pay for these.

7.0 PRIVACY

7.1 We take your privacy seriously. We do not pass your information onto any other business. If you do not wish to receive email, SMS or mail correspondence from us regarding special offers, events, news or promotions then please send us an email confirming that you wish to unsubscribe from such communication.

7.2 By proceeding with a Membership, you consent to us collecting, using, disclosing and dealing with your personal information in accordance with our privacy policy. In particular, you consent to the storage of your personal information.

7.3 You must tell us promptly if you change your contact or payment details or if there is a change to other relevant personal information, including anything that may affect health or safety.

8.0 PUTTING MEMBERSHIP ON HOLD

You may put your ongoing Membership on Hold for a minimum period of two (2) weeks and a maximum period of three months each year. Each year commences on the anniversary of your Commencement Date. 9.0 CANCELLING YOUR MEMBERSHIP

9.1 You may cancel your ongoing membership for any reason with 30 days written notice.

9.2 In the instance where you purchase your membership term in full/up front, we may refund half of the remaining balance where you provide a medical certificate stating you are physically and permanently incapacitated, or, have moved more than 15kms to Edge, and can provide proof via an updated photo ID or utilities bill.
